What is notice pay under Turkish law?
Under Article 17 of Labour Law No. 4857, a party terminating an indefinite-term employment contract must observe a notice period based on the employee's seniority: 2 weeks for less than 6 months, 4 weeks for 6 months to 1.5 years, 6 weeks for 1.5 to 3 years, and 8 weeks for 3 years or more. The party who fails to observe the notice period pays the other party compensation equal to the wages for that period. The obligation is mutual — an employee who quits without notice may owe the employer.
How is it calculated?
The base is the "dressed" gross wage: the bare gross salary plus the monthly value of regular benefits such as meal and transport allowances and recurring bonuses. The monthly dressed wage is divided by 30 and multiplied by the number of notice days. The severance pay ceiling does not apply to notice pay.
Taxes and deductions
Unlike severance pay, notice pay is subject to income tax under the progressive 2026 wage schedule (15% up to TRY 190,000, then 20%, 27%, 35% and 40%), applied on top of the employee's cumulative tax base for the year, plus stamp tax at 0.759%. No social security or unemployment insurance premiums are deducted (Law No. 5510, Art. 80).
