How is the rent increase cap determined?
Under Article 344 of the Turkish Code of Obligations, the rent increase for a renewed lease term cannot exceed the change in the consumer price index (CPI) based on twelve-month averages, as published by TurkStat for the previous lease year. The cap applies to both residential and roofed commercial leases.
The temporary 25% cap that applied only to residential leases expired on 1 July 2024. For renewals in July 2026 the maximum rate is 32.03%, based on the June 2026 figure.
Which month's rate applies?
The applicable figure is the twelve-month average CPI change of the month preceding the renewal month, because TurkStat publishes each month's data at the beginning of the following month. Our calculator handles this mapping automatically.
Rent determination lawsuits and the five-year rule
For leases running longer than five years, if the parties cannot agree, the judge may set a new rent in equity, considering the CPI change, the condition of the property and comparable rents. Since 1 September 2023, mediation is mandatory before filing rent-related lawsuits.
