What is the statutory attorney fee?
Under Articles 164 and 168 of the Attorneys Act (Law No. 1136), Turkish courts order the losing party to pay a minimum attorney fee, which belongs to the winning party's lawyer. Amounts are set by the Minimum Attorney Fee Tariff (AAÜT) prepared by the Union of Turkish Bar Associations. The current 2025-2026 tariff was published in the Official Gazette on 4 November 2025 (No. 33067) and remains in force as of July 2026.
How is the proportional fee calculated?
For monetary claims the fee is calculated on progressive brackets: 16% on the first TRY 600,000, 15% on the next 600,000, 14% on the next 1,200,000 and so on, down to 1% above TRY 18,600,000. The result cannot fall below the fixed fee of the court hearing the case (e.g. TRY 45,000 for courts of first instance) and cannot exceed the amount awarded or rejected. Example: a fully accepted claim of TRY 1,000,000 yields 600,000 × 16% + 400,000 × 15% = TRY 156,000.
Enforcement proceedings
In debt enforcement proceedings, claims up to TRY 56,250 carry a fixed fee of TRY 9,000 (never exceeding the principal); larger claims use the progressive brackets. If the debtor pays within the statutory payment period, the fee is reduced to three-quarters (Article 11/4 of the tariff).
