What does starting enforcement proceedings cost?
Fees for enforcement proceedings in Turkey are set by the Fees Act No. 492 (Article 29 and Tariff No. 1, Section B). For 2026 the fixed filing fee is TRY 732.00. Proceedings not based on a court judgment also require an advance fee of 0.5% of the claimed amount, which is later credited against the collection fee.
Service of process costs TRY 265.00 per debtor for physical PTT service (tariff of 4 February 2026) or TRY 20.00 via the electronic notification system (UETS). If an attorney files the proceeding, a power-of-attorney copy fee (TRY 104.00) and the bar association stamp (TRY 164.00) are added.
How is the enforcement attorney fee calculated?
Under the Minimum Attorney Fee Tariff 2025-2026 (Official Gazette 04.11.2025), claims up to TRY 56,250 carry a fixed fee of TRY 9,000, capped at the principal claim. Above that threshold the fee is progressive: 16% on the first TRY 600,000, 15% on the next TRY 600,000, and so on down to 1% above TRY 18,600,000. The result cannot fall below the fixed minimum, and the fee is charged to the debtor.
Collection fee and prison construction fee
When money is collected, a collection fee applies by stage: 4.55% before seizure, 9.10% after seizure but before sale, and 11.38% after a forced sale. The 0.5% advance fee is credited against it. Separately, a prison construction fee of 2% of the collected amount is deducted from the creditor and cannot be passed on to the debtor.
