Which fees are payable when filing a lawsuit in Turkey?
Judicial fees are set out in Tariff No. 1 annexed to the Fees Act No. 492 and are updated every 1 January. Two main fees are paid at filing: the filing fee (335.20 TRY before civil courts of peace, 732.00 TRY before first-instance and administrative courts in 2026) and the advance portion of the judgment fee.
Monetary claims are subject to a proportional judgment fee of 6.831% (68.31 per thousand) of the claim value; non-monetary cases pay a fixed judgment fee of 732.00 TRY, collected in full at filing.
How is the advance proportional fee calculated?
Under Article 28/(1)(a) of the Fees Act, one quarter of the proportional judgment fee is paid in advance at filing; the remainder is collected when the judgment becomes final. In damages claims for death or bodily injury the advance is one twentieth instead of one quarter. In practice the advance never falls below the fixed judgment fee (732.00 TRY in 2026), so for claims under roughly 42,863 TRY the advance is a flat 732.00 TRY.
The expense advance (CCP Art. 120)
In addition to fees, the claimant deposits an expense advance under Article 120 of the Code of Civil Procedure: notification costs equal to five notices per party (unit price 265.00 TRY since February 2026) plus a fixed 530.00 TRY for other transactions. Witness, expert and site-inspection costs are no longer part of the mandatory advance; courts request them separately as evidence advances (CCP Art. 324). Consumers filing before consumer courts are exempt from all judicial fees (Law No. 6502, Art. 73/2) but still deposit the expense advance.

Who ultimately bears the litigation costs?
As a rule, litigation costs including fees are imposed on the losing party (CCP Art. 326), and any unused expense advance is refunded after the judgment becomes final.
