What is the amendment (ıslah) fee?
Under Articles 176-182 of the Turkish Code of Civil Procedure, a party may amend its claim — most commonly to increase the claim amount after an expert report reveals the true loss. When the claim value is increased, Articles 30-32 of the Court Fees Act No. 492 require the missing proportional fee to be topped up on the difference; the amendment has no effect until the fee is paid.
The top-up equals the advance portion of the proportional judgment fee (6.831% of the difference): one quarter as a rule, or one twentieth in damages claims based on death or bodily injury (Article 28/1-a). The balance is collected from the losing party at the end of the proceedings.
No new filing fee
The filing (application) fee is paid once when the lawsuit is filed. Since an amendment is not a new lawsuit, no new filing fee is due — only the advance portion of the proportional fee on the increased amount. For example, increasing a claim from TRY 100,000 to TRY 250,000 creates a difference of TRY 150,000; the proportional fee is TRY 10,246.50 and the advance payable is TRY 2,561.63.
Claims for an indeterminate amount
In lawsuits filed for an indeterminate amount (Article 107/2 CCP), increasing the claim later is technically not an amendment: it is not limited to a single use and can even be made after cassation. The top-up fee, however, is calculated exactly the same way. In 2026 the proportional rate remains 6.831% and the minimum lump-sum judgment fee is TRY 732.00; in practice court cashiers may top small amounts up to this floor.
