How is time to serve calculated in Turkey?
Under Law No. 5275 on the Execution of Penalties, a convict does not serve the full sentence in prison. The conditional release (parole) threshold is 1/2 of the sentence for general offenses, 2/3 for offenses such as intentional killing, torture or basic sexual assault, and 3/4 for aggravated sexual offenses, drug trafficking and terrorism. Life imprisonment requires 24 years (30 for aggravated life; 30/36 for organised crime). In practice a year counts as 365 days and a month as 30 days, and pre-trial detention is credited day for day (TPC Art. 63).
Subtracting the probation (supervised release) period and detention credit from the conditional-release portion gives the approximate time actually spent in prison.
Probation periods and offense-date thresholds
The standard probation period is 1 year (Art. 105/A). For offenses committed on or before 30 March 2020, transitional Article 6 grants a 1/2 ratio and 3 years of probation (excluded offenses aside). Law No. 7571 (Official Gazette 25 Dec 2025) added 3 more years of early probation for offenses committed on or before 31 July 2023, subject to minimum-stay, good-conduct and application conditions, raising the total to 6 or 4 years. For offenses committed on or after 4 June 2025, at least 1/10 of the conditional-release period (minimum 5 days) must be served in prison.
Why is this only an estimate?
The 12th Judicial Package is still before Parliament as of July 2026 and may change execution ratios. Real computations also depend on the aggregation of multiple sentences, recidivism, juvenile rules, special personal circumstances, disciplinary record and enforcement-judge decisions. This tool never replaces the official computation issued by the enforcement prosecutor's office; always consult a criminal lawyer.
Frequently Asked Questions
What is conditional release under Turkish law?
After serving the statutory portion of the sentence with good conduct (1/2, 2/3 or 3/4 depending on the offense; 24/30 years for life sentences), the remainder is served outside prison under supervision (Law No. 5275, Art. 107).
How long is probation (supervised release)?
Normally 1 year. For offenses on or before 30 March 2020 it is 3 years, and Law No. 7571 adds 3 more years for offenses on or before 31 July 2023 (excluded offenses aside), up to a total of 6 years.
Is pre-trial detention deducted?
Yes. Time spent in custody and pre-trial detention is credited day for day against the sentence (Turkish Penal Code Art. 63).
Has the 12th Judicial Package become law?
No. As of July 2026 it is on the agenda of the General Assembly of Parliament. If enacted, execution ratios and probation rules may change.
Does this calculator replace the official computation?
No. The result is an approximation for information purposes only. The official document is issued by the enforcement prosecutor and many case-specific factors change the outcome; consult a criminal lawyer.
